The web portal http://www.reus.cat/ (hereinafter, the “Web Portal”) belongs to theREUS CITY COUNCIL (from now on, "The REUS CITY COUNCIL”) with NIF P4312500D and address at Plaça del Mercadal, no. 1 – 43201 Reus (Tarragona).
The user, by using the Web Portal, accepts this legal notice (hereinafter, “the Legal Notice”) and undertakes to use the Web Portal, as well as its services and contents, in accordance with this Legal Notice and under its sole and exclusive responsibility.
1. Identification of the Parties
The Legal Notice is signed, on the one hand, by theREUS CITY COUNCIL and, on the other hand, by the end user interested in the services offered through the Web Portal (hereinafter, the “User Person”) whose personal data are those provided by the latter.
2. Object and scope
This Legal Notice regulates the access, navigation and use of the Web Portal by the User.
3. Access and Use of the Web Portal
Access to the Web Portal, as well as the non-consensual use that may be made of the information contained therein is the sole responsibility of the person who makes it.
The User agrees to use the contents, information and data of the Web Portal in accordance with this Legal Notice, with the rest of the policies accessible through the Web Portal, with the application regulations, with the generally accepted good customs and with public order.
The REUS CITY COUNCIL will not be responsible for any consequences, harm or damage that could arise from this access, use or breach of this Legal Notice, nor will it be responsible for any security errors that may occur or any damages that may be caused in the computer system of the User Person (hardware and software) or to the files or documents stored therein as a result of: (i) the presence of a virus on the User's computer that is used to connect to the services and/or products offered by TheREUS CITY COUNCIL through the Web; (ii) browser malfunction; and (iii) the use of outdated versions thereof.
4. Rules of Use of the Web Portal
The REUS CITY COUNCIL reserves the right to cancel the account of the registered User, being able to proceed with the termination of the current contract. In particular, the cancellation may be carried out as a User Person in the event of detecting a breach of any of the contractual obligations contracted in this act, as well as in the event of observing a use of the Web Portal contrary to this Legal Notice, the Privacy Policy, Cookies Policy and/or good faith practices accepted in the sector.
In this sense, the User agrees to:
- Provide truthful information about the data requested in the forms provided by TheREUS CITY COUNCIL for access to certain content or services offered through the Web Portal and to keep them up to date. TheREUS CITY COUNCIL reserves the right, without prejudice to other legal measures at its disposal, to withdraw, deny or suspend access to the Web Portal, in the event that the data provided is or may be false, inaccurate or misleading. In any case, the User Person will be fully responsible for the data or content that they transmit or communicate to TheREUS CITY COUNCIL. In this sense, the User assumes responsibility for any damages that may arise from their improper use.
- Not to use the Web Portal or any of the elements that integrate it, to develop time-sharing operations, to become a provider of application services with to the extent that they were aimed at making possible the access of third parties to the platform or any of its components, through rental operations, administrative services or any other similar consideration, sharing them or putting them on the disposition of third parties.
- Do not use the Web Portal to collect personal data from other users.
- Not to use the Web Portal as a system for the management and exchange of information and / or illegal documentation, contrary to morality or public order, contrary to copyright and / or industrial property rights.
- Not to carry out acts of reverse engineering, taking requirements and other activities aimed at developing an online platform identical or similar to the one made available by TheREUS CITY COUNCIL, this activity may be considered an act of unfair competition and violation of intellectual and industrial property rights that TheREUS CITY COUNCIL shows on the platform.
- Do not subject the platform to workloads that are clearly aimed at destabilizing it, including denial of service (DDoS) attacks or similar situations. In the event that such situations are detected, the level of service indicated above will not be applicable, being considered an emergency situation.
- Do not remove, delete, alter, manipulate or in any way modify those notes, legends, indications or symbols that TheREUS CITY COUNCIL, as the rightful owner of the rights, incorporate into its properties in matters of intellectual or industrial property (for example, copyright, ©, ® and TM), either on the platform itself or in the associated material.
- Notify theREUS CITY COUNCIL any fact or situation that may have occurred and that could jeopardize the security of access by authorized users.
- Not to prevent the normal development of an event, contest, promotion or any other activity available through the Web Portal, whether altering or trying to alter, illegally or in any other way, the access, participation or operation of those, or falsifying the result thereof and / or using fraudulent methods of participation, through any procedure, and / or through any practice that violates or violates in any way this Legal Notice.
- Refrain from using the contents of the Web Portal for illicit purposes or effects, prohibited or contrary to those established here, harmful to the rights and interests of TheREUS CITY COUNCIL, of other users, third parties or in any way that may damage, disable, overload or deteriorate this Web Portal or prevent the normal use of it by users.
5. Links to other websites
This Legal Notice does not apply to third-party links and/or web pages that can be accessed through the Web Portal. Nor are the Privacy Policy and the Cookies Policy present on the Web Portal applicable.
In case of accessing other networks or computer resources, the User agrees to submit to the provisions of the corresponding privacy policies. Consequently, theREUS CITY COUNCIL is not responsible for the content or security measures adopted by them.
Likewise, the absence of viruses or other elements of the content linked from the Web Portal that could produce alterations in the computer system (hardware and software) in the documents or files of the User is not guaranteed, excluding also L 'REUS CITY COUNCIL of any liability arising from damages of any kind caused by all of the above.
In any case, theREUS CITY COUNCIL will proceed with the immediate removal of any link when the content to which it redirects may contravene national or international law, morality or public order.
6. Exclusion of guarantees and liability
The REUS CITY COUNCIL does not guarantee the permanent availability of the services offered on the Web Portal. However, it will make its best efforts to guarantee the regularity and proper functioning of these. For these purposes, theREUS CITY COUNCIL declares that it has adopted and will adopt all the necessary and reasonable measures, within its possibilities and the state of the technology, to guarantee the correct operation of the Web Portal.
However, theREUS CITY COUNCIL assumes no responsibility for any damages that may arise from disconnections, interferences or interruptions that may occur in accessing or browsing the Web Portal, or for any damages that may arise for the User or for third parties of the existence and spread of computer viruses or other harmful elements.
The REUS CITY COUNCIL nor does it assume any responsibility with regard to any errors or omissions that may exist in the content of the Web Portal, nor with regard to the actions that the User may take on the basis of this content.
7. Modification of the Legal Notice
The REUS CITY COUNCIL reserves the right to make, without prior notice, the modifications it deems appropriate in this Legal Notice, being the responsibility of the User to read them carefully, whenever you wish to use the Web Portal in order to check or make sure - the existence of modifications or changes to them, taking as a reference the date of the last update.
8. Intellectual and industrial property.
The User acknowledges and accepts that all industrial and intellectual property rights on the contents and/or any other element inserted by TheREUS CITY COUNCIL in the Web Portal (including, by way of example and not limitation, all those elements that make up the visual appearance, graphic image and other sensory stimuli that make up the Web Portal or "look and feel", brands, logos, names commercials, texts, images, graphics, designs, sounds, databases, software, flow diagrams, presentation, navigation architecture, as well as source codes) belong to TheREUS CITY COUNCIL and/or third parties who have assigned their rights. For these purposes, it will be understood as a Web Portal all those creations incorporated and expressed by TheREUS CITY COUNCIL by any tangible or intangible means and / or support, known or to be known, that is the object of protection by the normative dispositions in force in the matter of intellectual and industrial property.
The mere viewing, printing, downloading or temporary storage, either in whole or in part, of the contents and/or the elements inserted by TheREUS CITY COUNCIL on the Web Portal exclusively for personal, private and non-profit use by the User, provided that, in any case, the origin and/or author of the same is indicated and that, where appropriate, the copyright symbol appears and/or notes of industrial property of their holders. Any other use or exploitation of any right will be subject to the prior and express authorization specifically granted for this purpose by TheREUS CITY COUNCIL or by the third holder of the affected rights.
The use of these elements, their total partial reproduction, communication and/or distribution for commercial or profitable purposes, as well as their modification, alteration, decompilation and/or any other act of exploitation of the Web Portal, is strictly prohibited. whose image rights, has its exploitation right TheREUS CITY COUNCIL. For any use other than those expressly permitted, it will be necessary to obtain the prior written consent of the holder of the rights in question.
This Legal Notice does not confer on the User any other right of use, alteration, exploitation, reproduction, distribution or public communication of the Web Portal and/or its contents other than those expressly provided for here. Any other use or exploitation of any right will be subject to the prior and express authorization specifically granted for this purpose by TheREUS CITY COUNCIL or by the third holder of the affected rights.
Notwithstanding all of the above, if the User believes that any content of the Web Portal could violate intellectual and industrial property rights, please inform us as soon as possible, by sending an email to dpd.ajuntament@reus.cat.
9. Communications
From'REUS CITY COUNCIL, we will contact the User by email or provide information by posting notices on the Web Portal. For contractual purposes, the User expresses his consent to the use of this electronic means of communication and acknowledges that all contracts, notices, information and other communications that we send to him electronically comply with legal requirements.
The communications that the User Sends to us, will have to be realized preferably through electronic mail to the address dpd.ajuntament@reus.cat. You can also send a written communication to the attention of L'REUS CITY COUNCIL in Plaça del Mercadal, no. 1 – 43201 Reus (Tarragona).
10. Applicable law and competent jurisdiction
Current regulations will determine the laws that must govern and the jurisdiction that must know the relations between TheREUS CITY COUNCIL and to the User of the Web Portal.
However, in those cases in which this current regulation foresees the possibility for the parties to submit to a specific court, TheREUS CITY COUNCIL and the User, expressly waiving any other jurisdiction that may apply to them, will be subject to Spanish law and the Courts and Tribunals of Tarragona.
Additional information on data protection:
Personal data will be kept for the time strictly necessary until the purpose for which it was collected is achieved, and as long as the cause that legitimized the processing of such personal data is maintained. Once the cause that legitimized the processing has ended, the personal data will be kept properly blocked for the period of time that is appropriate in order to comply with the legal limitation periods to avoid possible infringements.
At any time you can exercise your rights of access, rectification, deletion, limitation, portability or opposition to the processing of your data, by sending a written communication to the address of L'REUS CITY COUNCIL, to your email address dpd.ajuntament@reus.cat, through the Electronic Headquarters of theREUS CITY COUNCIL (https://seu.reus.cat/seu/), or in person at the Citizen Service Office (OAC) in Plaça Mercadal, no. 1, 43201 - Reus (Tarragona).
